PROSECUTION is considered when:
- the potential for serious injury or death is apparent
- there has been a serious injury or death
- there are numerous or repeat violations, previous warning letters, or a history of non-compliance.
Workers - not just employers and supervisors - can be fined for violations of the Occupational Health and Safety Act and Regulations.
OH&S Fines and Prosecution
When deciding whether a fine or prosecution is appropriate, the OH&S office will consider:
- Compliance history
- Harm or potential harm to workers
- Level of cooperation of the employer in correcting hazardous situations
If a Safety Officer finds a repeat violation ( the same for which orders have been written in the past three years) a fine or prosecution may result.
Failure to report a serious accident or serious injury will result in a fine or prosecution.
