How many levels of appeal are there?
There are two levels in the claim appeal process.
The Hearing Officer Review
If you are dissatisfied with a claim decision, you may request a review of the decision by the Hearing Officer. This is the first level of appeal. The Hearing Officer is appointed by the President of the board. The Hearing Officer reviews all the evidence and may reverse, vary or confirm the original decision. If you disagree with that decision, you may appeal it to the Workers' Compensation Appeal Tribunal.
A Committee of the Appeal Tribunal is the second and final level of appeal of a claim. The committee is made up of three members of the Tribunal, one of whom is an employers' representative and another who is a workers' representative. The Chair or the Alternate Chair of the Tribunal presides over the committee.
The committee may reverse, vary or confirm the decision of the Hearing Officer. Each case is decided on its own merit. Decisions of the Workers' Compensation Appeal Tribunal committee are final: you may not appeal any further; however, you may request a new hearing if you believe the committee misinterpreted the law or policy. If you obtain new, relevant evidence after the committee makes a decision, you may also submit that information to the Tribunal for a new decision.
