How to File a Claim

Deadline for submitting a claim

A worker must report a work-related injury or disease to their employer as soon as possible after it occurs. Employers have three days from the worker's notification to submit their report to the YWCHSB.

Workers must file for compensation with the YWCHSB within one year. The YWCHSB may consider a claim filed past the deadline if it is satisfied there is a good reason for the delay.

Information required

Before the YWCHSB can determine whether an injured worker is entitled to compensation, it must have complete details of the accident. The following three forms, when properly completed, provide the necessary information.

These forms are available at the YWCHSB building in Whitehorse. The completed forms should be returned immediately online, by fax, in person or mailed to the YWCHSB at 401 Strickland Street, Whitehorse, Y1A 5N8.

Note: Workers should file a Report of Injury/Illness if medical treatment was required off the job site and/or the worker needed time off work, beyond the day of their injury.

Workers do not need to file a Report of Injury/Illness if the injury only required first aid treatment on the job site and if the worker did not need time off work, beyond the day of the injury.

However, the employer must keep a written record of these incidents.  This documentation can protect workers in case further complications arise.

It is illegal for employers and workers to form an agreement to not report a work-related injury or to not apply for compensation.

Recurrence of an Injury

If the injury recurs, the worker should follow these three steps:

  • Report the recurrence to the employer,
  • Seek medical treatment immediately and have a report sent to the Board, and
  • Write or call the YWCHSB outlining why the worker believes the new injury to be related to the original.

If it is found that the present problem results from the original injury, compensation may be paid.
