How to Obtain a Claim File

On any given claim, a number of important decisions are made concerning entitlement, benefits, medical treatment, fitness for employment and rehabilitation.

Workers and their employers, or their representatives can review a worker's file, under supervision, at the YWCHSB office. They can also request a copy of the file. The first copy given to the worker or their representative and to the employer or their representative is free. After the first copy, there is an administrative fee of $50.00 per copy, and $0.25 per page for photocopying.

The person requesting the information must complete a request for disclosure form. The form states that they may use the information in the file to prepare for a review or an appeal, but that any other use is illegal.

Employers have access to information in their worker's file that pertains only to the compensable injury, and is not a disclosure of personal information that constitutes an unjustified invasion of personal privacy or confidentiality of the worker. The worker or the dependant of a deceased worker is informed of the employer's request, and has 14 days to respond or to object in writing. The President of the YWCHSB will handle any disputes over the release of information.

The employer of an injured worker is kept informed on the status of the claim, on the worker's entitlement to benefits, on the worker's fitness to return to work, of when benefits are terminated, and on whether case management is taking place. The employer can request a Progress Report concerning the worker. The Progress Report contains the status of the worker's fitness to return to work, whether the worker will be sent outside of the territory for medical aid or rehabilitation, and any proposed or active rehabilitation plan.

Any information released to an employer in a Progress Report or a Decision Report is confidential and may not be used by an employer for any purpose other than an appeal unless authorized by the board.

Disclosure forms are available at the front desk, on the Website (forms), or by calling (867) 667-5645 or 1-800-661-0443. The copy can be mailed or picked up.
