    DEFINITIONS

    1.02

    (1) In these Regulations only new definitions will be explained: for other definitions, see the Workers' Safety and Compensation Act. 
    "administrative controls"

    means the provision, use and scheduling of work activities and resources in the workplace, including planning, organizing, staffing and coordinating, for the purpose of controlling risk; « contrôles administratifs »

    "electrical worker"

    means an electrical journeyperson or a person with equivalent training and experience who can perform electrical work under the supervision of an electrical journeyperson; « ouvrier en électricité »

    "engineering controls"

    means the physical arrangement, design or alteration of workstations, equipment, materials, production facilities or other aspects of the physical work environment, for the purpose of controlling risk; « contrôles d’ingénierie »

    "heavy equipment"

    means mobile equipment; « matériel lourd »

    "IDLH"

    means “Immediately Dangerous to Life or Health”; and includes a high hazard atmosphere where the concentration of oxygen or flammable or toxic air contaminants would cause a worker without respiratory protection to be fatally injured or would have irreversible and incapacitating effects on that worker’s health; « DIVS »

    "manufacturer’s specification"

    means the written instructions or recommendations of a manufacturer of a machine, materials, tools, equipment or mobile equipment that outline the manner in which the machine, materials, tools or equipment is to be erected, installed, assembled, started, operated, used, handled, stored, stopped, adjusted, maintained, repaired or dismantled, and includes an installation, operating or maintenance manual and drawings; « spécifications du fabricant »

    "NFPA"

    means the National Fire Protection Association; « NFPA »

    "professional engineer"

    means a person who is registered and licensed to practise engineering under the provisions of the Engineering Profession Act; « ingénieur »

    "public way"

    means any publicly or privately owned cul-de-sac, boulevard, thoroughfare, street, road, trail, avenue, parkway, viaduct, lane, alley, square, bridge, causeway, trestleway, sidewalk, highway, ditch along any public way and highway right-of-way within 30 metres of the centerline; « voie publique »

    "qualified person"

    means a person who has education, experience and training in the recognition, evaluation and control of hazards associated with the work; « personne qualifiée »

    "SCBA"

    means self contained breathing apparatus; « APRA »

    "violence"

    means any of the following that occurs in a workplace or is work-related:

    (a) the threatened, attempted, or actual exercise of physical force by a person that causes, or is likely to cause, an injury to a worker; or

    (b) a threatening statement made or any conduct engaged in by a person that gives a worker reasonable cause to believe that the worker is at risk of injury;

    (2) In these Regulations, harassment of a worker by a person

    (a) means bullying, or any other objectionable conduct or inappropriate comment, by the person

    i. that occurs in a workplace or is work-related,

    ii. that the person knows, or ought reasonably to know, is likely to be unwelcome, and

    iii. that adversely affects the worker's physical or psychological well-being or constitutes a threat to the worker's health and safety;

    (b) includes the person engaging in bullying or a course of inappropriate comments to, or in relation to, the worker, or a course of objectionable conduct against the worker

    i. that occurs in a workplace or is work-related,

    ii. that the person knows, or ought reasonably to know, is likely to be unwelcome, and

    iii. that relates to, or is motivated by, the worker's sex, sexual orientation, gender identify or gender expression; and

    (c) does not include reasonable conduct of a person who is an employer or supervisor in respect of the management of workers or a workplace.
