General Information

The WCA makes a distinction between a required medical exam or other evaluation and an independent medical exam or other evaluation.

Required and/or independent examinations/evaluations are needed for adjudicative, case management, review and appeal decisions.

Examinations/evaluations should respect a worker's right to privacy and be minimally intrusive, while providing the board with the factual evidence needed to adjudicate the claim and to ensure appropriate treatment of the injured worker.

A worker's autonomy and his or her right to consent to their medical treatment should be safeguarded. The board will make every effort to inform and involve the worker in treatmentdecisions.

Required exams/evaluations are used as a mechanism for gathering facts and information pertaining to a claim.

Independent exams/evaluations are used as a mechanism for resolving a dispute of fact.
